Data Protection For Tech Companies; What Is The NDPR?

• Nigeria NDPR is a necessary regulatory intervention and very well reflects a modern model environment for companies to thrive.
• What Is The NDPR?
• It’s important to point out that the bedrock of data protection in Nigeria is S 37 of the Nigerian Constitution, which clearly protects privacy rights.
• It’s on this premise that the NDPR was established.
• The Nigeria Data Protection Regulation is Nigeria’s major legislation on data protection.
• Scope And Applicability Of This Regulation
• The applicability of the regulation is with respect to activities involving processing of personal data.
• Consequently, all tech companies involved in collection, storage, and processing of personal data and information are within the regulatory purview of the NDPR.
• These companies are for the purpose of this regulation referred to as ‘Data Controllers’.
• The Applicability of the NDPR is however limited to the Nigerian domain, that is, natural persons resident in Nigeria and Nigerian citizens outside Nigeria.
• Regulatory Body For NDPR
• The chief regulator for the NDPR in Nigeria is the ‘Data Protection Bureau’ assuming the role in 2022. The regulatory roles of the NDPR was initially undertaken by the NITDA.
• Nigeria’s NDPR is a very important regulation for the tech space in Nigeria. The vulnerability of personal data and information in the digital space have necessitated developments like the NDPR and every company involving in anything data and information must not only stay updated on the regulation but must routinely interface with the regulators for effective compliance.
